These Terms of Service (“Terms”) are a binding agreement between you and Creatozen (“Creatozen”, “we”, “us”) governing your access to and use of the Creatozen website and application (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. The Service
Creatozen is a software tool that helps creators and their teams manage Instagram conversations and growth: automating and qualifying direct messages, replying to comments, maintaining a CRM, planning content, and reporting analytics. Features and limits depend on your plan and may change over time.
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate information and keep it up to date.
- You are responsible for your account, your team members' actions, and keeping your credentials secure. Notify us promptly of any unauthorised use.
- One person or entity is the account owner and is responsible for all activity and charges in the workspace.
3. Your content and connected accounts
- You retain all rights to the content, messaging rules, contact data, and other material you put into the Service (“Customer Data”).
- You grant us a limited licence to host, process, and transmit Customer Data solely to provide and support the Service.
- You are responsible for having the rights and permissions needed to connect an Instagram account and to process the messages, comments, and contact data involved, including any consent required from the people you communicate with.
4. Instagram and Meta compliance
The Service connects to Instagram through Meta's official APIs. Your use of those features is also subject to Meta's terms, including the Instagram Terms of Use, the Meta Terms, and the Meta Platform Terms. You agree that you will not use the Service to:
- send spam, bulk unsolicited messages, or content that violates Instagram's Community Guidelines or Platform policies;
- misrepresent yourself, automate activity in a way Meta prohibits, or attempt to evade Meta's rate limits or enforcement;
- scrape or collect data from Instagram other than through the permissions you have been granted.
Meta may change, limit, or withdraw API access at any time. If that happens, some features may stop working, and we are not liable for that loss of functionality.
5. Acceptable use
You will not, and will not allow anyone to:
- use the Service for anything unlawful, deceptive, harassing, or harmful;
- send messages that are misleading about who is sending them where disclosure is legally required;
- upload malware, probe or breach security, or disrupt the Service;
- reverse engineer, resell, or provide the Service to third parties except as expressly allowed;
- exceed plan limits through automated means or circumvent usage metering.
We may suspend or terminate access for a material or repeated breach, or where required to protect the Service, other users, or Meta's platform.
6. AI-generated output
Some features generate text and suggestions using AI. Output can be inaccurate or unsuitable. You are responsible for reviewing and approving what the Service sends on your behalf and for configuring your rules and human-handoff settings appropriately. You own the output you generate through the Service, to the extent permitted by law.
7. Plans, fees, and billing
- Paid plans are billed in advance on a recurring basis through our payment processor. Prices are shown in the app.
- Usage above your plan's limits may incur additional charges or be restricted, as described in the app.
- Fees are non-refundable except where required by law or expressly stated.
- We may change pricing with reasonable prior notice; changes take effect at your next renewal.
- You can cancel at any time; cancellation takes effect at the end of the current billing period.
8. Intellectual property
The Service, including its software, design, and content (excluding Customer Data), is owned by Creatozen and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. All rights not expressly granted are reserved. Feedback you give us may be used without obligation to you.
9. Third-party services
The Service integrates with third parties such as Meta, payment processors, and infrastructure and AI providers. Your use of those integrations may be subject to their terms, and we are not responsible for their acts or omissions.
10. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce any particular business result, number of leads, or revenue.
11. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the 12 months before the event giving rise to the claim.
12. Indemnity
You will indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your Customer Data, your use of the Service, or your breach of these Terms or of applicable law or Meta's terms.
13. Term and termination
- These Terms apply while you use the Service.
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate your access for breach, non-payment, or as needed to comply with law or platform requirements. We will give notice where practical.
- On termination, your right to use the Service ends. Data handling on termination is described in the Privacy Policy and Data Deletion page.
14. Changes to these Terms
We may update these Terms. We will post the new version here with an updated date and, for material changes, give notice in the app or by email. Continued use after a change means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. The courts located in India will have exclusive jurisdiction over any dispute, subject to any mandatory rights you have under local law.
